Onyx Wellness respects your privacy and is committed to protecting your personal information.

Information We Collect

We may collect personal information such as your name, email address, phone number, and information you voluntarily provide through intake forms or program participation.

This includes health-related information you give us on the Intake and Health Screening and Physical Activity Screening forms, session recordings if you consent to them, payment information processed by our payment processor, and basic website analytics.

How Your Information Is Used

Your information is used to:

● Provide coaching services
● Communicate with you
● Improve programs and client experience
● Determine whether coaching is appropriate and safe for you
● Meet legal obligations, including mandatory reporting under KRS 620.030, KRS 209.030, and KRS 209A.030
● Establish or defend a legal claim

We do not sell or share your personal information with third parties for marketing purposes.
We share information with service providers who help us operate — scheduling, video conferencing,
email, and payment processing — each of whom is permitted to use it only to provide that service.

How Long We Keep It

We keep client records for the longer of seven (7) years after your last session or the period required to
defend a claim. Session recordings are deleted within twenty-four (24) months. You may request deletion
of your information at any time, and we will comply within thirty (30) days unless retention is required by
law or to defend a pending or threatened claim.

Data Protection

We take reasonable steps to protect your information. However, no system is completely secure, and you
share information at your own discretion.

If a security breach compromises unencrypted personal information, we will notify affected clients in the
most expedient time possible and without unreasonable delay, consistent with KRS 365.732.

Children

We do not knowingly collect information online from anyone under thirteen (13). Information about a
client under eighteen is collected from a parent or guardian under the Minor Client Addendum.

Not HIPAA-Covered

Onyx Wellness is not a covered entity under HIPAA. Health information you share with us is not
protected health information under that law, and the protections in this policy are contractual rather than
HIPAA obligations. Coaching communications should not be assumed to carry the protection Kentucky
law gives to communications made for the purpose of counseling.

Marketing Communications

We will send you service messages about your sessions and account. We will send marketing emails or
texts only with your consent, and you can opt out at any time by replying STOP or using the unsubscribe
link.
